# Class Deviation 2017-O0009 - Products and Services from the African Host Nation-Djibouti

## Summary

This deviation implements NDAA FY2017 section 899A, which authorizes Department of Defense (DoD) to limit competition to, or provide a preference for, products and services from Djibouti. Contracting Officers (COs) may use these authorities without a Federal Acquisition Regulation (FAR) 6.3 justification and approval or the Balance of Payments Program. New Defense Federal Acquisition Regulation Supplement policy sections and three new clauses support the authority.

## Required Contracting Officer Actions

1. Before using a procedure under 225.7798-3(a), prepare and execute a written determination per 225.7798-4. COs sign individual determinations for acquisitions under $93 million.
2. Use provision 252.225-7985 in solicitations that also include clause 252.225-7986 and insert the USAFRICOM price evaluation factor in paragraph (d).
3. Use clause 252.225-7986 in solicitations and contracts that provide a preference for Djibouti products or services under 225.7798-3(a)(2).
4. Use clause 252.225-7977 in solicitations and contracts that limit competition to Djibouti products or services under 225.7798-3(a)(1).
5. Do not use 252.225-7000, 252.225-7001, 252.225-7002, 252.225-7035, 252.225-7036, 252.225-7044 or 252.225-7045 in solicitations or contracts that include 252.225-7985, 252.225-7986 or 252.225-7977.
6. Do not use 252.225-7020 or 252.225-7021 in solicitations or contracts that include 252.225-7977.
7. Include the written determination in the contract file. For class determinations, document each action and confirm it falls within the class determination scope.
8. When evaluating offers under 252.225-7985, apply the evaluation procedures at 225.7798-5 instead of FAR 25.502(c) procedures.
9. Do not apply FAR subpart 25.4 trade agreement procedures when using a competition-limiting procedure under 225.7798-3(a)(1) for acquisitions supporting DoD activities in Djibouti.

## Notes

AbilityOne Exception: The authority to limit competition or provide a preference does not apply to products on the AbilityOne Procurement List if a qualifying nonprofit can deliver them on time.

Class Determinations: Only the head of the contracting activity, without re-delegation, may execute class determinations or individual determinations for acquisitions valued at $93 million or more.

Commercial Item Applicability: The new provisions and clauses apply to commercial (Part 12) acquisitions as well as non-commercial ones.

Trade Agreements Act: When the Trade Agreements Act applies and 252.225-7977 is not used, COs must still use the Trade Agreements provision and clause prescribed at 225.1101(5) and (6).
